La Demeure du Chaos a célébré le 9 décembre 2009 ses dix ans de combat judiciaire pour la liberté d’expression.
La chambre criminelle de la Cour de Cassation saisie dans le cadre d’un deuxième pourvoi a rendu un arrêt du 15 décembre 2009 demandant la destruction des 3 123 œuvres d’art formant le corpus de la Demeure du Chaos créée par le plasticien thierry Ehrmann en 1999.
La Demeure du Chaos/ Abode of Chaos dixit le “New York Times,” née le 9 décembre 1999 de l’acte conceptuel de thierry Ehrmann, est une œuvre au noir se nourrissant du chaos alchimique de notre 21e siècle, tragique et somptueux dont les braises naissent le 11 Septembre.
Elle est devenue aujourd’hui, avec plus de 1200 reportages de presse écrite et audiovisuelle de 72 pays, en 10 ans, une “Factory” incontournable et unique dans le monde, selon la presse internationale. C’est un musée à ciel ouvert et gratuit, présentant plus de 3123 œuvres, où convergent chaque année désormais 120 000 visiteurs.
La Demeure du Chaos, dans le cadre de son statut d’E.R.P. (Etablissement Recevant du Public) muséal, a reçu 437 130 visiteurs du 18/02/2006 au 30/010/2009, dont 21 % de visiteurs étrangers. Elle est aussi une résidence d’artistes.
Depuis 1999, soit 10 ans, la Mairie de Saint-Romain-au-Mont-d’Or s’acharne dans son négationnisme artistique et persiste à demander la remise en état du bâtiment, ce qui signifie tout simplement la destruction intégrale de La Demeure du Chaos.
Ce procès historique sera plaidé devant la Cour Européenne des Droits de l’Homme dans le cadre de l’article 10 de la Convention Européenne des Droits de l’Homme sur la liberté d’expression. La jurisprudence sur cet article a régulièrement fait condamner la France.
Le rejet de ce pourvoi témoigne de la volonté de la Cour de Cassation de juger les prescriptions d’urbanisme et l’application qui en a été faite par la Cour de Grenoble comme ne portant pas atteinte à la liberté d’expression garantie à l’article 10 de la Convention Européenne des Droits de l’Homme.
Plus que jamais, thierry Ehrmann, avec le Collectif des artistes et le poids des 108 000 signataires de la pétition, va plaider avec férocité sa cause pour faire valoir et respecter le droit à la liberté d’expression, en formant un recours contre le deuxième arrêt rendu par la Cour de Cassation, auprès de la Cour Européenne des droits de l’homme contre la France.
Cette décision, selon thierry Ehrmann, porte atteinte à sa liberté d’expression et dans le fait qu’il ne peut pas être soumis à la seule réglementation du Droit de l’Urbanisme, l’expression artistique étant un droit national et universel depuis la nuit des temps.
A ce titre, la pétition pour sauver la Demeure du Chaos de la destruction continue plus que jamais. Elle permet de porter ce conflit hors du commun devant la Cour Européenne des Droits de l’Homme.
A l’heure où la France s’interroge désespérément sur sa perte d’influence artistique dans le monde, sa politique culturelle et notamment sur la notion de gratuité du musée, la Demeure du Chaos est une vraie réponse atypique.

On 9 December 2009, the Abode of Chaos celebrated 10 years of combat for freedom of expression.
The Cassation Court’s criminal chamber presiding over a second appeal has delivered an order dated 15 December 2009 for the destruction of the 3,123 works of art forming the corpus of the Demeure du Chaos created by the artist and sculptor thierry Ehrmann in 1999.
Founded by the conceptual act of thierry Ehrmann on 9 December 1999, the Abode of Chaos (per the NYT) is an œuvre au noir (nigredo) inspired by the alchemical chaos of the 21st Century, whose tragic and yet sumptuous embers were ignited on 11 September 2001.
After just 10 years – and more than 1200 press and TV articles in 72 countries around the world – the international art community today recognises the Abode of Chaos as a unique and “sacred” artistic factory. This free open-air museum with more than 3123 works attracts more than 120,000 visitors each year.
Between February 2006 and June 2008, under its E.R.P. status (Etablissement Recevant du Public) status, the Abode of Chaos attracted 437,130 visitors of whom 21% came from outside France. The place also hosts a number of artists in residence.
Since 1999, the local authority of Saint-Romain-au-Mont-d’Or (where the Abode is located) has been pursuing a crusade of artistic negation against the Abode of Chaos and continues to call for “the restoration of the building to its original state”… which means effectively means the complete destruction of the Abode!
This historic case will now be submitted to the European Court of Human Rights in the framework of Article 10 of the Convention for the Protection of Human Rights and Fundamental Freedoms. The case law on this Article 10 has frequently ruled against France in the past.
The wording of the Cassation Court’s rejection of our appeal clearly reflects its concern to uphold French building regulations, and their application by the Grenoble Appeal Court, as being coherent with the freedoms of expression guaranteed in Article 10 of the Convention for the Protection of Human Rights and Fundamental Freedoms.
Backed by the artists’ collective and the weight of 108,000 petition signatories, thierry Ehrmann is more than ever determined to pursue the vigorous battle to defend the rights of all people to freedom of expression by launching an appeal against this second order delivered by the Cassation Court – and against French legislation – before the European Court of Human Rights.
Thierry Ehrmann considers that this decision violates his freedom of expression and that this freedom cannot be uniquely subjected to Building Regulations since artistic expression has been a national and universal right since the beginning of time.
In the current context, the petition to save the Abode of Chaos from destruction is of paramount importance. It will allow this extraordinary legal dispute to be taken before the European Court of Human Rights.
In an era when France is desperately seeking solutions to its diminishing global artistic influence and seems unsure of where to steer its national cultural policy (particularly with respect to the principle of free entry to museums), the Abode of Chaos is a bold and original response.

The answer brings me back to the year 1999, as i found myself looking once again for this gnostic world, after the golden calf was devoured during the great pagan feast of the last century. Experience one more time this terrible ordeal and transcend through art to finally reach redemption. Rebirth through the very first damnation, this insanity we received at birth like a supreme unction. A maniacal fury, my sulphurous mistress and her mood disorders, will once again be my accomplice. She will bring my quill to life, for me to write a very long story, that emerges from the dawn of time, quenches its thirst in the Alchemical Chaos, materia prima of this tragic and sumptuous XXI Century, and incarnates itself in my flesh and creations and recover the world of the Dwellings of the Philosophers. The Great Work had to be accomplished, no matter what the price, no matter how loud the beggars’s howl, the vindication of the men in black or the moralists’s anathema. But many forgot that since the beginnings of law, there is no crime nor offence when the accused is in a state of insanity or constrained by an act of God. This dementia of artistic creation, the power of its creative madness have since milleniums made it possible for mankind to build temples, catacombs, mass graves, places of genuflexion, calvaries, labyrinths, Golgotha, oratories, via crucis sanctuaries, priories and cathedrals of light. Each of these words, dear faithful Reader, describes the Abode of Chaos and its dual aspect: the Spirit of the Salamander, the alchimic breath of the Abode. To your actual question, “why this darkness?” would therefore simply answer: “when you see the darkness, rejoice for the Opus starts now…”
